Directions to Exempt

Under Part 3 of Schedule 4 to the Legal Services Act, the LSB has the power to exempt certain general or specific changes to the Regulatory Arrangements from the approval process by issuing a direction.kljbegt

23 January 2013 Exemption Direction 51 Alteration to the Bar Standards Board’s Bar Training Regulations LSB directs the exemption from the requirement for LSB approval for alterations made by The Bar Standards Board to the Bar Training Regulations amending the content of Admission and Call Declarations.
2 January 2013 Exemption Direction 50 Alteration to the ILEX Professional Standards Continuing Professional Development Regulations, Associate Prosecutor Rights of Audience and Litigation Certification Rules, and Rights of Audience Certification Rules LSB directs the exemption from the requirement for LSB approval for alterations made by the ILEX Professional Standards to its Continuing Professional Development Regulations, Associate Prosecutor Rights of Audience and Litigation Certification Rules, and Rights of Audience Certification Rules to provide for a change to the period constituting the Continuing Professional Development year which will become 1 October to 30 September from 1 October 2013, as well as to reflect the change in year to 2013 throughout the relevant regulations.
12 December 2012 Exemption Direction 49 Alterations to the Solicitors Regulation Authority Compensation Fund Rules and Handbook Glossary LSB directs the exemption from the requirement for LSB approval for alterations made by the Solicitors Regulation Authority (SRA) to Rules 1, 2 and 26 of the Compensation Fund Rules 2011 and Rule 4 of the Handbook Glossary to update them by removing the ‘sunset’ clause and references and provisions relating to the ‘transitional period’.
30 October 2012 Exemption Direction 48 Alteration to the Costs Lawyers Standards Board’s Training and CPD Rules for Cost Lawyers LSB directs the exemption from the requirement for LSB approval for alterations made by The Cost Lawyers Standards Board to the Training and CPD Rules to clarify that CPD records may be subject to audit and to make minor alterations to events that quaify for continuing professional developments.
17 October 2012 Exemption Direction 47 Alterations to the Council for Licensed Conveyancers (CLC) Handbook and Frameworks LSB directs the exemption from the requirement for LSB approval of miscellaneous amendments made by the CLC to its Handbook and Frameworks, as set out at Annex 1 to the exemption direction. This direction is deemed to be made and effective from 17 October 2012.
18 July 2012 Exemption Direction 46 Alterations to The Master of Faculties Notaries (Qualification) Rules 1998 LSB directs the exemption from the requirement for LSB approval for alterations made by the The Master of Faculties to its Notaries (Qualification) Rules 1998 to clarify the arrangements for appeals against decisions by the Qualification Board
26 June 2012 Exemption Direction 45 Alteration to Ilex Professional Services Limited Rights of Audience Certification Rules and Associate Prosecutor Litigation and Rights of Audience Certification Rules LSB directs the exemption from the requirement for LSB approval for alterations made by Ilex Professional Services Limited (IPS) to the Rights of Audience Certification Rules and Associate Prosecutor Litigation and Rights of Audience Certification Rules to require advocates to notify IPS of their intention to enter the Quality Assurance Scheme for Advocates (Crime) Scheme. 25 May 2012 Exemption Direction 43 Alterations to the SRA’s regulatory arrangements to introduce the Quality Assurance Scheme for Advocates (Crime) Notification Regulations LSB directs the exemption from the requirement for LSB approval for alterations made by the SRA in respect of the Quality Assurance Scheme for Advocates (Crime) Notification Regulations to require advocates to notify the SRA of their intention to enter the Quality Assurance Scheme for Advocates (Crime) Scheme.
25 May 2012 Exemption Direction 42 Alterations to the grace period for compliance with requirements to have in place an approved compliance officer for legal practice (COLP) and compliance officer for finance and administration (COFA) LSB directs the exemption from the requirement for LSB approval for alterations made by the SRA to the end date of the grace period which allows firms to be treated as being in compliance with Rule 8.5 of the SRA Authorisation Rules for Legal Services Bodies and Licensable Bodies 2011 or Regulation 4.8 of the SRA Practising Regulations 2011, when they do not have an approved compliance officer for legal practice (COLP) and compliance officer for finance and administration (COFA) in place. This direction is deemed to be made and effective from 25 May 2012.
18 April 2012 Exemption Direction 41 Alterations to the SRA Handbook to introduce The SRA Glossary 2012 and provide for miscellaneous amendments to the Handbook LSB directs the exemption from the requirement for LSB approval for amendments made by the SRA to the Handbook to introduce The SRA Glossary 2012, as set out at Annex 1 to the exemption direction, and make miscellaneous amendments to the SRA Handbook, as set out at Annex 2 to the exemption direction. This direction is deemed to be made and effective from 18 April 2012.
18 April 2012 Exemption Direction 40 Alterations to the SRA Practice Framework Rules 2011 and the SRA Authorisation Rules for Legal Services Bodies and Licensable Bodies 2011 in relation to immigration work LSB directs the exemption from the requirement for LSB approval for amendments made by the SRA to the Practice Framework Rules 2011 and the SRA Authorisation Rules for Legal Services Bodies and Licensable Bodies 2011 to provide for licensed bodies to be authorised by SRA to undertake immigration work when also authorised to undertake reserved legal activities. This direction is deemed made on and to be effective from 18 April 2012.
18 April 2012 Exemption Direction 39 Alterations to the SRA Handbook to introduce the SRA Insolvency Rules 2012 LSB directs the exemption from the requirement for LSB approval for amendments made by the SRA to the SRA Handbook to introduce the SRA Insolvency Rules 2012. The new rules provide that solicitors and registered European lawyers authorised by the SRA to undertake insolvency work do so in compliance with the Insolvency Service’s Insolvency Code of Ethics. This direction is to be deemed made on and to be effective from 18 April 2012.
11 April 2012 Exemption Direction 38 Regulatory Arrangements relating to the Master of the Faculties, Rule 10 of the Public Notaries (Practising Certificate) Rules 1982 LSB directs the exemption from the requirement for LSB approval of alterations to Rule 10 of the Public Notaries (Practising Certificate) Rules 1982. This direction is deemed to be made and effective from 11 April 2012.
22 February 2012 Exemption Direction 37 Regulatory Arrangements relating to the BSB Code of Conduct and Practising Certificate Rules on authorisation for carrying out immigration advice and services LSB directs the exemption from the requirement for LSB approval of alterations to the Bar Standards Board Code of Conduct (introduction of Rule 206A) and Practising Certificate Rules (amendment to Rule 20) both in relation to authorisation of the carrying on of immigration advice and services. This direction is deemed to be made and effective from 22 February 2012.
15 February 2012 Exemption Direction 36 Regulatory Arrangements relating to the BSB Code of Conduct, Bar Training Regulations and Practising Certificate Rules LSB directs the exemption from the requirement for LSB approval of alterations to the Bar Standards Board Code of Conduct, Bar Training Regulations and Practising Certificate Rules. This direction is deemed to be made and effective from 15 February 2012.
6 January 2012 Exemption Direction 35 Regulatory Arrangements relating to the BSB Disciplinary Tribunal Rules LSB directs the exemption from the requirement for LSB approval of alterations to the Bar Standards Board Disciplinary Tribunal Rules. This direction is deemed to be made and effective from 6 January 2012.
23 December 2011 Exemption Direction 34 Regulatory Arrangements relating to the Solicitors Disciplinary Tribunal (Appeals) (Amendment) Rules 2011 LSB directs the exemption from the requirement for LSB approval of the Solicitors Disciplinary Tribunal (Appeals) (Amendment) Rules 2011. This direction is deemed to be made and effective from 23 December 2011.
21 December 2011 Exemption Direction 33 Alterations to Regulatory Arrangements relating to the Practising Certificate Rules and changing references to ‘recognised bodies’ to authorised bodies’ LSB directs the exemption from the requirement for LSB approval of changes: to the Practising Certificate Rules, Rule 5 to clarify that an application for a practising certificate will only be fully made if the relevant documents and the relevant practising certificate fee has been received by the Bar Standards Board; and changing references to ‘recognised bodies’ to ‘authorised bodies’.  This direction is deemed to be made and effective from 21 December 2011.
20 December 2011 Exemption Direction 32 Alterations to Regulatory Arrangements relating to the SRA Handbook LSB directs the exemption from the requirement for LSB approval of the SRA Alterations to Regulatory Arrangements Rules [2011]. This direction is deemed to be made and effective from 20 December 2011.
13 December 2011 Exemption Direction 31 Alterations to Regulatory Arrangements relating to CLC ABS Framework LSB directs the exemption from the requirement for LSB approval of alterations to the CLC ABS Framework to update in accordance with the Rehabilitation of Offenders Act Exemption Order 2011. This direction is deemed to be made and effective from 13 December 2011.
22 November 2011 Exemption Direction 30 Alterations to Regulatory Arrangements relating to the Rights of Audience Certification Rules & the Associate Prosecutors Rights of Audience & Litigation Certification Rules LSB directs the exemption from the requirement for LSB approval of changes to the Rights of Audience Certification Rules and the Associate Prosecutor Rights of Audience and Litigation Certification Rules to exclude from membership of the Admissions and Licensing Committee (ALC) Fellows who are also members of the IPS Board; and alterations to the Associate Prosecutors Rights of Audience and Litigation Certification Rules to clarify that independent members shall be in majority for each ALC. This direction is deemed to be made and effective from 22 November 2011.
10 November 2011 Exemption Direction 29 Alterations to Regulatory Arrangements relating to the CLSB Disciplinary Rules and Procedures LSB directs the exemption from the requirement for LSB approval of changes to the Cost Lawyers Disciplinary Rules and Procedures to change the membership of the Conduct Committee and the Conduct Appeals Committee. This direction is deemed to be made and effective from 10 November 2011.
8 November 2011 Exemption Direction 28 Alterations to Regulatory Arrangements relating to the CLC Handbook LSB directs the exemption from the requirement for LSB approval of changes to the CLC Handbook to clarify the CLC’s ability to take action under the old rules and guidance where necessary. This direction is deemed to be made and effective from 8 November 2011.
23 September 2011 Exemption Direction 27 Alterations to Regulatory Arrangements relating to the BSB’s Hearings before the Visitors Rules 2010 LSB directs the exemption from the requirement for LSB approval of changes to the BSB’s Hearings before the Visitors Rules 2010 to clarify the role of retired judges. This direction is deemed to be made and effective from 23 September 2011.
16 September 2011 Exemption Direction 26 Alterations to Regulatory Arrangements relating to the CLC’s Compensation Fund contributions for the practising year commencing 1 November 2011 LSB directs the exemption from the requirement for LSB approval of the CLC’s Compensation Fund contributions for the practising year commencing 1 November 2011. This direction is deemed to be made and effective from 16 September 2011.
13 September 2011 Exemption Direction 25 Alterations to Regulatory Arrangements relating to the CLC’s Appointment Regulations 2011 resulting from the CLC’s designation as a licensing authority LSB directs the exemption from the requirement for LSB approval of the CLC’s Appointment Regulations 2011. This direction is deemed to be made and effective from 13 September 2011.
08 September 2011 Exemption Direction 24 Alterations to Regulatory Arrangements relating to the SRA’s Commencement, Repeals and Amendment (No.2) Rules [2011] LSB directs the exemption from the requirement for LSB approval of the SRA Commencement, Repeals and Amendment (No.2) Rules 2011. This direction is deemed to be made and effective from 8 September 2011.
5 August 2011 Exemption Direction 23 Alterations to Regulatory Arrangements relating to the SRA’s Commencement, Repeals and Amendment Rules [2011] LSB directs the exemption from the requirement for LSB approval of the SRA Commencement, Repeals and Amendment (Amendments relating to designation of the Law Society as a licensing authority) Rules 2011. This direction is deemed to be made and effective from 5 August 2011.
2 August 2011 Exemption Direction 22 Alterations to Part X of the BSB’s Code of Conduct LSB directs the exemption from the requirement for LSB approval of Part X of the BSB’s Code of Conduct. This direction is deemed to be made and effective from 2 August 2011.
22 July 2011 Exemption Direction 21 Minor alterations to the BSB’s Inns’ Conduct Committee Rules LSB directs the exemption from the requirement for LSB approval of four minor changes to the BSB’s Inns’ Conduct Committee Rules. This direction is deemed to be made and effective from 22 July 2011.
20 July 2011 Exemption Direction 20 Alterations to Regulatory Arrangements relating to the SRA’s Practising Certificate Fee Determination [2011] and Recognised Body Fee Determination [2011] LSB directs the exemption from the requirement for LSB approval of the SRA’s Practising Certificate Fee Determination [2011] and Recognised Body Fee Determination [2011]. This direction is deemed to be made and effective from 20 July 2011.
15 July 2011 Exemption Direction 19 Alterations to Regulatory Arrangements relating to the SRA’s Qualified Lawyers Transfer Scheme Amendment Regulations 2011 LSB directs the exemption from the requirement for LSB approval of the SRA’s Qualified Lawyers Transfer Scheme Amendment Regulations 2011. This direction is deemed to be made and to be effective from 15 July 2011.
25 May 2011 Exemption Direction 18 Alterations to Regulatory Arrangements relating to the BSB’s Rule 807 and the definition of Legal Advice Centres LSB directs the exemption from the requirement for LSB approval of amendments to: Rule 807 and the definition of Legal Advice Centres in Part X of the Code of Conduct. This direction is deemed to be made and to be effective from 25 May 2011.
25 January 2011 Exemption Direction 17 Alterations to Regulatory Arrangements relating to the BSB's Code of Conduct Rules 203.1 and 401 LSB directs the exemption from the requirement for LSB approval of amendments to: Rule 203.1 to clarify that all barristers of less than three years’ standing must be supervised regardless of whether they work in a single capacity or dual capacity; and to Rule 401(a) so that a self-employed barrister may supply legal services if instructed by a “Court” as defined in Part X of the Bar Code of Conduct.
05 January 2011 Exemption Direction 16 Alterations to Regulatory Arrangements relating to the ILEX Rights of Audience Certification Rules LSB directs the exemption from the requirement for LSB approval of amendments to the Rights of Audience Certification Rule 21 (membership of Admissions and Licensing Committee). This direction is deemed to be made on and to be effective from 5 January 2011.
30 November 2010 Exemption Direction 15 Alterations to Regulatory Arrangements relating to the ILEX Continuing Professional Development Regulations 2011 LSB directs the exemption from the requirement for LSB approval of amendments to the ILEX Continuing Professional Development Regulations 2011. This direction is deemed to be made on and to be effective from 30 November 2010.
26 October 2010 Exemption Direction 14 Alterations to Regulatory Arrangements relating to the SRA’s Publication and Reconsideration Policies LSB directs the exemption from the requirement for LSB approval of amendments to the SRA’s Publication and Reconsideration Policies. This direction is deemed to be made on and to be effective from 26 October 2010.
15 October 2010 Exemption Direction 13 Alterations to Regulatory Arrangements relating to the BSB’s Practising Certificate Rules (Annex D) and Rule 901.1 of the Code of Conduct LSB directs the exemption from the requirement for LSB approval of amendments to the BSB’s Practising Certificate Rules (Annex D) and Rule 901.1 of the Code of Conduct. This direction is deemed to be made on and to be effective from 15 October 2010.
20 August 2010 Exemption Direction 12 Alterations to Regulatory Arrangements relating to the commencement of the Legal Ombudsman LSB directs the exemption from the requirement for LSB approval of amendments to Approved Regulators’ Regulatory Arrangements that are listed within the direction. This direction is deemed to be made on and to be effective from 20 August 2010.
20 August 2010 Exemption Direction 11 Alterations relating to the Master of the Faculties Notaries (Supervision Fees) Regulation 2010 LSB directs the exemption from the requirement for LSB approval for amendments to the Master of the Faculties Notaries (Supervision Fees) Regulation 2010. This direction is to be deemed made on and to be effective from 20 August 2010.
20 August 2010 Exemption Direction 10 Alterations to SRA QLTS Day One Outcomes assessment LSB directs the exemption from the requirement for LSB approval for amendments to the SRA QLTS Day One Outcomes assessment. This direction is to be deemed made on and to be effective from 20 August 2010.
6 August 2010 Exemption Direction 9 Alterations to rules 204 and 508 of Bar Code of Conduct LSB directs the exemption from the requirement for LSB approval for amendments to the Bar Code of Conduct (Rule 204 and 508) determined by the BSB. This direction is to be deemed made on and to be effective from 6 August 2010.
21 July 2010 Exemption Direction 8 Alterations relating to the SRA’s Solicitors’ Compensation Fund Rules 2010 LSB directs the exemption from the requirement for LSB approval for amendments determined by the SRA of the Solicitors’ Compensation Fund Rules 2010 which sets the individual practitioner and firm contributions to the Compensation Fund. This direction is to be deemed made on and to be effective from 21 July 2010.
19 July 2010 Exemption Direction 6 Alterations relating to the BSB’s Hearings before the Visitors Rules and Complaints Rules. LSB directs the exemption from the requirement for LSB approval for amendments made by the BSB to its Hearings before Visitors Rules and Complaints Rules. This direction is to be deemed made on and to be effective from 16 July 2010.
13 July 2010 Exemption Direction 7 Alterations relating to the SRA’s alterations to Rule 4 of the Code of Conduct. LSB directs the exemption from the requirement for LSB approval for amendments made by the SRA to Rule 4 of the Code of Conduct. This direction is to be deemed made on and to be effective from 13 July 2010.
30 April 2010 Exemption Direction 5 Alterations relating to the BSB’s Interim Suspension Rules and update of references to Bar Council, Bar Standards Board and Training Regulations. LSB directs the exemption from the requirement for LSB approval for amendments made by the BSB in relation to its Interim Suspension Rules and any updates of references to Bar Council, Bar Standards Board and Training Regulations within the Code. This is to update the current arrangements in light of the changes regarding Legal Disciplinary Practices and ensure consistency within the Code. This direction is to be deemed made on and to be effective from 30 April 2010.
26 March 2010 Exemption Direction 4 Alterations relating to the BSB’s Continuing Professional Development regulations. LSB directs the exemption from the requirement for LSB approval for amendments made by the BSB in relation to its Continuing Professional Development regulations. This is to maintain the current arrangements in light of the introduction of the “authorisation to practise” regime under section 13(2) and Schedule 5 of the Legal Services Act 2007. This direction is to be deemed made on and to be effective from 22 March 2010.
31 December 2009 Exemption Direction 3 Alterations relating to CIPA and ITMA arrangements – transitional (Paragraph 19(3) and (4) of Schedule 4 direction). LSB directs the exemption from the requirement for LSB approval regulations made by ITMA in relation to section 83A Trade Marks Act 1994 and by CIPA in accordance with Section 275A of the Copyright, Designs and Patents Act 1998 and submitted prior to 1 January. This is to facilitate the transition from ownership of the relevant registers from the Intellectual Property Office to ITMA and CIPA on 1st January 2010. This direction is to be deemed made on and to be effective from 1 January 2010.
30 December 2009 Exemption Direction 2 Alterations relating to compliance with the Internal Governance Rules (Paragraph 19(3) and (4) of Schedule 4 direction). LSB directs the exemption from the requirement for LSB approval for alterations to Approved Regulators’ Regulatory Arrangements that are made in order to achieve compliance with the Internal Governance Rules, that have been subject to non-compliance notification requirements and that have been agreed by the LSB as part of on-going Section 30 implementation arrangements. This direction is to be deemed made on and to be effective from 1 January 2010.
30 December 2009 Exemption Direction 1 Alterations falling below a de minimus line (Paragraph 19(3) and (4) of Schedule 4 direction). LSB directs the exemption from the requirement for LSB approval for the types of alterations to Approved Regulators’ Regulatory Arrangements that are listed within the direction. These changes are considered to fall below a de minimus line. This direction is to be deemed made on and to be effective from 1 January 2010.
